Ariana Biermann Speaks Out About the ‘Misconception’ Regarding Her DUI Arrest: ‘I Didn’t Do This’

PEOPLE previously reported that Biermann was arrested in August 2022 after an officer responded to a collision involving the Mercedes G-Wagon she was driving and smelled alcohol on her breath. Per the report, she denied drinking alcoholic beverages but admitted to smoking a THC vape pen the night before, which was also recovered from her bag at the scene.
At the time, her attorney Justin Spizman, of Hawkins Spizman law firm, told PEOPLE that Biermann denied any wrongdoing.
“Ariana was involved in a minor fender bender. When police arrived on scene, the investigating officer immediately initiated an investigation for DUI,” he said in a statement. “Despite Ariana’s constant invocation that she was upset and anxious from the minor accident, the officer incorrectly concluded she was impaired by alcohol.”
“That was not the case. She wholly denies these allegations and intends to fight these charges because she is not guilty of them,” he added.
In May of this year, Biermann entered a no contest/guilty plea to reckless driving and possession of drug-related objects in exchange for the prosecution dropping charges of driving under the influence, underage drinking and traffic violations.
“They offered me this in August, and I said, you know what? I’ll take it,” she explained to Giudice. “So whatever. Move on.”
The Don’t Be Tardy alum was also sentenced to two years probation, 40 hours of community service, over $2,000 in fines, enrollment in a victim impact program and has been ordered to abstain from consuming alcoholic beverages or drugs.
“I am literally gonna have a damn six pack,” Biermann joked of life with “no more wine.”
Giudice, who is starring alongside Biermann in Next Gen NYC, agreed: “Honestly, the positive that me and Ariana both said about this, is she’s gonna get in the sickest shape of her life.”
